ECJ publishes notice of EU Commission action to force Ireland to collect Apple State aid

The EU Court of Justice of the European Union today published notice of the EU Commission’s court action to force Ireland to collect illegal State aid from Apple’s Irish subsidiaries.

The Commission’s court action, brought on December 5, 2017, seeks to force Ireland to recover up to 13 billion euros from Apple Sales International and Apple Operations Europe. The Commission declared Ireland’s aid to the subsidiaries illegal and incompatible with EU internal market on August 31, 2016. The aid resulted from tax rulings issued by Ireland to the subsidiaries in 1991 and  2007.

In its court action, the Commision declares that Ireland did not recover the aid within four months of notification of the Commission’s decision, as it was obligated to do, nor has Ireland taken all measures necessary to implement the Commission decision.

The EU Commission announced in October that it was taking Ireland to court over the matter.
